HIPAA Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Effective October 28, 2026. This notice applies to Gustav Fischer, MD and his care team at Multnomah Orthopedic Clinic, 5050 NE Hoyt Street, Suite 626, Portland, OR 97213.
Privacy contact: Gustav Fischer, MD, at the clinic address above or 503-231-1426. Contact us to exercise these rights, request a paper copy, or make a complaint. Requests may need to be in writing.
Your rights
- Access your records. You may inspect or request an electronic or paper copy of the medical and billing information we maintain about you. We generally respond within 30 days. A reasonable, cost-based copying fee may apply. If access is denied, we will explain why and any review rights.
- Request a correction. Ask us to amend information you believe is incorrect or incomplete. If we deny your request, we will explain why in writing within 60 days, and you may submit a statement of disagreement.
- Choose confidential communications. Request a particular contact method or address. We accommodate reasonable requests.
- Request restrictions. Ask us to limit information used or shared for treatment, payment, operations, or with people involved in your care. We generally need not agree. We must honor a request not to disclose information about an item or service to your health plan for payment or operations when you have paid in full yourself, unless disclosure is required by law. Agreed restrictions may have emergency-treatment exceptions.
- Receive an accounting. Request a list of certain disclosures made during the preceding six years. Disclosures for treatment, payment, operations, and certain other exceptions are excluded. One accounting per 12 months is free; we will explain any fee for additional requests.
- Receive this notice. A paper copy is available promptly on request, even if you previously accepted electronic delivery.
- Use a representative. A person legally authorized to act for you may exercise your rights after we verify that authority.
How we use and share information
As permitted by law, we use and disclose health information to provide treatment, obtain payment, and operate the practice. For example, we may share information with a treating physical therapist, submit information to your insurer to pay a claim, or review records to improve care. Service providers acting on our behalf must protect information as required by law.
Subject to applicable legal conditions, we may also disclose information for public health and safety, including disease reporting, product recalls, adverse drug reactions, suspected abuse or neglect, and serious threats; approved research; health oversight and audits; workers’ compensation; authorized law enforcement and special government functions; organ or tissue donation; and coroners, medical examiners, or funeral directors. We may disclose information when required by law, including to HHS for compliance review, or in response to court orders, administrative orders, or subpoenas that meet legal requirements.
Your choices and permission
You may tell us whether to share relevant information with family, friends, others involved in your care or payment, or disaster-relief organizations. If you cannot express a preference, we may use professional judgment to make permitted disclosures in your best interest.
We require your written authorization for uses and disclosures not otherwise described or permitted by law, including marketing, sales of health information, and most disclosures of psychotherapy notes. You may revoke an authorization in writing at any time, except to the extent we have already relied on it. If we contact you for fundraising, you may opt out of further fundraising communications.
Additional protections
We follow Oregon and other applicable laws when they provide stronger confidentiality protections, including applicable restrictions on mental health, HIV-related, genetic, and substance use disorder information. Some disclosures require additional authorization or other specific legal authority.
If we receive substance use disorder records protected by 42 CFR Part 2, those records cannot be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you without your written consent or a qualifying court order and subpoena. If Part 2 records are used for fundraising, we will first give clear notice and a choice about receiving those communications.
Our responsibilities
We must protect the privacy and security of your protected health information, follow this notice while it is in effect, provide you with a copy, and notify you as required if a breach compromises unsecured protected health information. We will not use or disclose information beyond this notice without your written authorization unless the law permits or requires it.
Complaints
You may complain to our privacy contact or to the U.S. Department of Health and Human Services Office for Civil Rights, 200 Independence Avenue SW, Washington, DC 20201, or 1-877-696-6775. We will not retaliate for a complaint or for exercising your rights.
